1Purpose of This Notice

Insured Plus LLC is dedicated to safeguarding your personal privacy and maintaining strict confidentiality over your sensitive data. This Privacy Notice Statement explains our operational practices regarding the collection, use, maintenance, disclosure, and security of your Personally Identifiable Information (PII) and Protected Health Information (PHI).

This notice applies whenever our agency assists you with health and dental insurance quotes, subsidy and tax credit eligibility evaluations, application submissions, and plan enrollments through authorized Health Insurance Exchanges (including the Federally-Facilitated Marketplace and State-Based Exchanges), Qualified Health Plan (QHP) issuers, and ancillary benefit carriers.

2Legal Authority to Collect Information

Our authority to collect, handle, and transmit PII and PHI is established under Sections 1311, 1312, and 1411 of the Patient Protection and Affordable Care Act (Public Law 111-148), federal Marketplace privacy regulations codified at 45 CFR § 155.220 and 45 CFR § 155.260, and applicable state insurance codes governing licensed producers and agencies.

3Categories of Information We Collect

To determine your eligibility for insurance affordability programs (such as Advance Premium Tax Credits [APTC] and Cost-Sharing Reductions [CSR]), verify identity, and process policy applications, we may collect:

  • Contact & Demographic Details: Full legal name, date of birth, residential and mailing address, telephone numbers, email address, gender, marital status, and household size.
  • Identification & Legal Status: Social Security Numbers (SSNs), tax filing status, citizenship status, and immigration document details (for individuals applying for coverage).
  • Financial & Tax Household Data: Projected annual household income, employment status, employer contact information, and access to employer-sponsored health benefits.
  • Coverage & Health Preferences: Current insurance status, tobacco use status, preferred medical providers, and prescription drug requirements necessary to evaluate appropriate plan networks.

4Authorized Uses and Disclosures

We collect and use your data strictly to execute authorized insurance and exchange functions:

  • Verifying household eligibility for coverage and financial assistance through state or federal exchange platforms.
  • Assisting with plan comparison, application submission, policy enrollment, and annual renewals.
  • Providing support for mid-year Qualifying Life Events (QLEs) and special enrollment periods.
  • Facilitating the resolution of Data Matching Issues (DMIs) or documentation requests from exchange authorities.

Authorized Recipients:

Your information is shared only with trusted entities essential to completing your enrollment:

  • Federal and State Health Insurance Exchanges: CMS/HealthCare.gov and applicable State-Based Exchange platforms responsible for processing eligibility determinations.
  • Insurance Carriers: Licensed insurance companies offering the Qualified Health Plans or supplemental policies you elect to apply for.
  • Certified Direct Enrollment Platforms: Secure, CMS-compliant enrollment partners and web-broker platforms used to transmit applications securely.
  • Regulatory Authorities: State Departments of Insurance or federal regulatory bodies when strictly required by applicable law, audit, or court order.

We do not sell, rent, lease, or monetize your personal information to third-party marketing firms or external commercial entities.

5Voluntary Nature of Information

Providing personal information to Insured Plus LLC is entirely voluntary. However, because federal and state exchange platforms require specific demographic, household, and financial verifications to calculate subsidies and establish coverage, withholding required details will prevent us from processing your enrollment or securing premium tax credits on your behalf.

6Documented Consumer Consent

Under exchange regulations, licensed agents must obtain and maintain documented consumer consent before searching for applications, accessing consumer accounts, or executing enrollments.

  • We record consent via written authorization, secure digital signature, or recorded verbal agreement meeting federal and state script standards.
  • In compliance with regulatory retention mandates, all consumer consent documentation and application audit trails are retained securely for a minimum of ten (10) years.

7Security and Data Protection Safeguards

Insured Plus LLC enforces administrative, physical, and technical safeguards designed to protect PII and PHI against unauthorized access, loss, or misuse in compliance with 45 CFR § 155.260:

  • Technical Controls: Advanced data encryption during transit (TLS/SSL) and at rest, multi-factor authentication (MFA) across all administrative tools, and automated session timeouts.
  • Administrative Controls: Strict role-based permissions, annual compliance training, and continuous oversight of data workflows.
  • Physical Controls: Secure device storage, clean-desk standards, and privacy screen protections during consumer consultations.

8Your Privacy Rights

You maintain the right to inspect, correct, and manage your personal data:

  • Right of Access: You may request a summary of the personal information retained in your agency file.
  • Right to Correction: You may request corrections to any inaccurate, outdated, or incomplete PII/PHI.
  • Right to Revoke: You may revoke your consent or change your designated Agent of Record at any time by submitting written notification to our agency.
